The report was produced by the Ombudsperson for Children and Adolescents with the collaboration of the Istituto degli Innocenti of Florence as part of the activities set out by the agreement signed on 13 March 2018 to carry out research, study, monitoring, documentation and analysis activities in the area of childhood and adolescence.
Although listening to minors in court is provided for by law, the law does not regulate its modalities.
Knowing the state of the art of the right to be heard in court of children and young people is crucial to protect their rights. In order to understand how listening is performed and what resources are available to courts, the Ombudsperson decided to submit a questionnaire to all the juvenile courts, some ordinary courts and their public prosecutor's offices, collecting information on protocols. It also did this to disseminate the culture of listening to children and young people.
